Circleville City Council convened in Council Chambers, City Hall, 127 South Court Street, Circleville, Ohio, on Tuesday, February 21 at 8:00 P.M. The following members were present: David M. Crawford, President; Bruce Bell, At Large ;Bob Bensonhaver, At Large; David Martin, At Large; Tom Klitzka, First Ward; Barry Keller, Second Ward; Anne Bella Canan, Third Ward; Bill Bangert, Fourth Ward and Linda M. Chancey, Clerk.
Crawford called the meeting to order at 8:00 p.m. The Pledge of Allegiance was recited and prayer was offered. Council minutes of February 7, 2006 were filed as corrected.
In response to a question by Martin about the traffic signal on Rt. 23 South by Taco Bell, Louis McFarland stated there is new technology in signalization used to enhance safety. The service department is planning on incorporating this technology on approval with ODOT into the intersection project.
In response to a question by Martin about the funding of the vacant positions in the safety department, Mayor Jean Droste stated the city budget is very tight at this time, unless council passes the reduced tax credit ordinance the city has no funds at this time to fill those positions.
ORDINANCE FOR THIRD READING
An Ordinance Authorizing The Mayor Of The City Of Circleville To Enter Into An Annexation Agreement Between The City Of Circleville, Ohio And The Board Of Township Trustees Of Circleville Township, Pickaway County, Ohio , Pursuant To Section 709.192 Of The Revised Code.
Canan stated this was reviewed by the Long Range committee. This is a comprehensive plan that will be beneficial for the city. The 1,750 acres of land would be available for commercial economic development.
Canan motioned to amend this ordinance to reflect that council has received the revised agreement dated February 8, 2006. Klitzka seconded. The amendments are as follows:
1. Page 7 – Articles III (H) - 3 sentences added. This has been reviewed and approved by Chief Gray and Sheriff Radcliff. Upon execution of any annexation to petition within the commercial development districts the Sheriff of Pickaway County may retain law enforcements and other duties prescribed by statute to his office within the annexed area. The Sheriff of Pickaway County, township and city will mutually agree to a plan for the transition of police services to be provided by the city of Circleville. The terms of the transition plan including compensation for services shall be negotiated between the township, city and the Sheriff.
2. Page 8 - Articles III Section 5 – reference to COUNTY omitted. Legally this agreement is between the city and township so county cannot be included.
3. Page 10 - Articles VII – 2nd sentence changes “will endeavor” to “shall”.
Roll call. Motioned carried. The amendment is made. Canan motioned for passage. Klitzka seconded.
Roll call. Yeas 5 - (Bangert, Bell, Canan, Keller, Klitzka). Nays 2 - (Bensonhaver and Martin).
Ordinance passes and was assigned # 02-11-2006.
Nate Green, Economic Development for the City of Circleville and Pickaway County and the CIC.
Reported to council on the new developments in the city and county about the Smurfit property on Rt. 23, Pickaway Common, (the former Wal Mart facility) and Crane Plastic building.
Bensonhaver motioned to add to the agenda a codified ordinance. It has been through the judicial committee and met the 72-hour receipt for council and has the Law Director’s stamp on it.
Keller seconded. Roll call. Motion carried.
An Ordinance Approving The Editing And Inclusion Of Certain Ordinances As Parts Of The Various Component Codes Of The Codified Ordinances Of The City Of Circleville, Ohio And Declaring An Emergency. Bensonhaver stated this was reviewed by the judicial committee. This is for the codification of the city’s ordinances. Bensonhaver motioned to suspend the rules. Canan seconded. Roll call. Rules are suspended. Bensonhaver motioned for passage. Martin seconded.
Roll call. Ordinance passes and was assigned # 02-12-2006.
Bangert motioned to adjourn the meeting at 8:36 pm. Martin seconded.
