January 17, 2006

Circleville City Council convened in Council Chambers, City Hall, 127 South Court Street, Circleville, Ohio, on Tuesday, January 17 at 8:00 P.M. The following members were present: David M. Crawford, Bruce Bell, At Large ;Bob Bensonhaver, At large; Tom Klitzka, First Ward; Barry Keller, Second Ward; Anne Bella Canan, Third Ward; Bill Bangert, Fourth Ward and Linda M. Chancey, Clerk.
Absent: David Martin.

Crawford called the meeting to order at 8:00 p.m. The Pledge of Allegiance was recited and prayer was offered. Council minutes of January 3, 2006 were filed as corrected and January 10, 2006 was filed as recorded.

It was announced that council and elected officials have received their 2005 financial disclosure statements.
In addition, the mayor, law director, and council president submitted 2005 annual reports for their areas of responsibility and the auditor submitted 2005 preliminary report for her office.
Bensonhaver motioned to accept the correspondences and to place them on file. Bell seconded. Motion carried

ORDINANCES & RESOLUTIONS FOR SECOND READING
An Ordinance Amending Section 1501.01 Of The Codified Ordinances Of The City Of Circleville Which Adopted The 2000 Ohio Fire Code (OFC), As Established By The Ohio Division Of State Fire Marshal, Department Of Commerce, So As To Now Adopt The 2005 Fire Code, And Declaring An Emergency.
Bell stated this was reviewed by the safety committee via the finance committee meeting. This ordinance updates the 2005 Fire Codes and procedures. Bell motioned for passage. Keller seconded. Roll call. Motioned carried. Ordinance passes and was assigned # 01-03-2006

A Resolution Authorizing And Directing The City Of Circleville To Submit An Application For Community Development Block Grants Funds. Bensonhaver stated this was reviewed by the judicial committee. This is for an application for the CDBG grant for the CHIPS PROGRAM. Bensonhaver motioned for passage. Klitzka seconded. Roll call. Motioned carried. Resolution passes and was assigned # 01-04-2006.

A Resolution Approving The Fiscal Year 2006-2008 Community Housing Improvement Program.
Bensonhaver stated this was reviewed by the judicial committee. This is the 2006-2008 CHIPS Housing Improvement program for home buyers. Bensonhaver motioned for passage. Canan seconded. Roll call. Motioned carried. Resolution passes and was assigned #01-05-2006.

An Ordinance Adopting A Residential Anti-Displacement And Relocation Assistance Plan For The City Of Circleville’s Community Development Block Grant Program. Bensonhaver stated this was reviewed by the judicial committee. This is for an anti-displacement program under the CHIPS grant. Bensonhaver motioned for passage. Canan seconded. Roll call. Motioned carried. Ordinance passes and was assigned # 01-06-2006.

ORDINANCE FOR SECOND READING
An Ordinance Appointing A Clerk Of The City Council For The City Of Circleville, Ohio, And Declaring An Emergency. Bensonhaver motioned to suspend the rules. Keller seconded. Roll call. Motioned carried. Bensonhaver motioned for passage. Klitzka seconded. Roll call. Motion carried.
Ordinance passes and was assigned # 01-07-2006.

ORDINANCES FOR FIRST READING
An Ordinance Authorizing The Mayor Of The City Of Circleville To Enter Into An Annexation Agreement Between The City Of Circleville, Ohio And The Board Of Township Trustees Of Circleville Township, Pickaway County, Ohio , Pursuant To Section 709.192 Of The Revised Code. Canan stated this was reviewed by the Long Range committee. This is a comprehensive plan that will be beneficial for the city. The 1,750 acres of land would be available for commercial economic development.
Bensonhaver voiced concerns that the property would be annexed without owner approval and the need for public hearings. Klitzka stated this is for the future development of Circleville. Canan motioned to hold for a second reading. Bangert Seconded. Roll call. Motioned carried. Ordinance will be held until February 7, 2006.

An Ordinance Authorizing The Fire Chief To Enter Into A Contract To Purchase Mobilems Data Collection System Software For EMS Administrative And State Reporting And Obviating Formal Bidding And Advertising. Canan stated this was reviewed by the Long Range committee. This ordinance is for the fire department to purchase Mobilems data collection software for use by the city’s EMS department. Canan motioned to hold for a second reading. Bangert seconded. Roll call. Motioned carried. Ordinance will be held until February 7.

NEW BUSINESS
Keller motioned to nominate Bruce Bell for President Pro-tem. Klitzka seconded. Motion carried.
Keller motioned to elect Bruce Bell by unanimous ballot. Klitzka seconded. Motion carried
Keller motioned to excuse council member David Martin. Bell seconded. Motion carried.

Bell motioned to adjourn the meeting an 8:35 pm. Bangert seconded. Motion carried.
